EU–US Privacy ShieldCommission Implementing Decision (EU) 2016/1250 on the adequacy of the protection provided by the EU–U.S. Privacy Shield

Repealed/superseded

§1Summary

Synopsis

Implementing Decision 2016/1250 found, under Directive 95/46/EC, that the EU–U.S. Privacy Shield ensured an adequate level of protection for personal data transferred from the EU to certified organisations in the United States. It replaced the Safe Harbour decision that the Court of Justice had invalidated in 2015. The Court of Justice struck the Decision down on 16 July 2020 in Schrems II (C-311/18), because of inadequate protection against US government surveillance. Standard contractual clauses stayed available.
